in5 Terms of Use
Effective October 16, 2026
These Terms of Use (the "Terms") govern your use of in5.us and its subdomains (the "Site") and the services we offer through it (the "Services"). The Site is operated by TIKA Solutions LLC, 20860 N Tatum Blvd, Suite 300, Phoenix, AZ 85050, USA ("TIKA", "we", "us"). Questions: support@in5.us.
Please read these Terms before using the Site. By using the Site you agree to them. If you do not agree, do not use the Site.
1. Acceptance and changes
Using the Site — browsing it, creating an account, downloading anything, or posting anything — means you accept these Terms. We may change these Terms at any time. The current version, with its effective date, is always at in5.us/legal/terms/; continuing to use the Site after the effective date of a change means you accept the change. If you breach these Terms, your permission to use the Site ends automatically.
2. Definitions
"Materials" are the downloads, files, text, images, videos, documentation, templates, software, code and other content we make available on the Site. "User Materials" are anything you post, upload or send through the Site or the Services, including forum posts, comments, showcase submissions, support requests and the files attached to them. "Software" is the in5 plug-in and any other software we distribute, which is licensed under its own End User License Agreement (the "EULA"), available at in5.us/legal/eulas/. "Account" is an in5 customer or partner account created through the Site.
3. Our intellectual property
The Site, the Materials and the in5 name and logo are protected by copyright, trademark and other laws. We grant you no rights in them except as these Terms, the EULA or a separate written agreement say. You may not copy, republish, distribute, sell, reverse-engineer or create derivative works from the Site or the Materials, except that documentation, help articles and templates may be used as their own notices allow.
4. Software, Accounts and subscriptions
The Software is licensed, not sold, under the EULA. If these Terms and the EULA conflict about the Software, the EULA governs. Subscriptions, licenses, payments, renewals and cancellations are governed by the EULA and the terms shown at purchase. Keep your Account credentials to yourself; you are responsible for activity under your Account until you tell us at support@in5.us that it has been compromised.
5. Acceptable use
You agree not to: - access or try to access any part of the Site, any Account or any Materials you are not authorized to use; - post or send anything that infringes another person's rights, or that you do not own or have permission to share; - do anything that could damage, overload, disrupt or compromise the Site, our servers or other users — including uploading malicious code, scraping at scale, probing for vulnerabilities, or circumventing rate limits, bot protection or access controls; - send unsolicited or bulk messages to our users or addresses, impersonate anyone, or use an in5.us address as a return address; - post content that is unlawful, defamatory, harassing, obscene, hateful, or that exploits or endangers minors; - use the Site in violation of any applicable law.
We may remove any User Materials, and may suspend or end access to any part of the Site, at any time and without notice, where we believe these Terms have been breached or the Site or other users are at risk. We do not read private support correspondence except to provide support, or where we have reason to believe a message threatens the Site, our users or the law requires it.
6. Your submissions
Ownership stays with you. You keep all rights in your User Materials. You confirm that you own them or have permission to share them, including permission from anyone shown in images or videos.
What we may do with them. You grant TIKA a non-exclusive, worldwide, royalty-free license to use, store, copy, display and adapt your User Materials only to operate, display, support and improve the Site and the Services — for example, to show a forum post or showcase entry you chose to publish, to reproduce a bug you reported, or to answer your support request.
Public posts. Content you choose to publish in a public area of the Site (a forum, comment thread or showcase) is public by nature and is not confidential. We may display it on the Site; the license to display it ends when you delete it, except for copies others have already made or that remain in backups for a limited time.
Support requests and files. Material you send to support is confidential. We use it only to resolve your request, keep it only as long as needed to do so, and handle any personal information in it under our Privacy Policy and, for business customers, EULA §11.
No public attribution. We will not publish your name, your company's name or your logo, and will not identify you or your company as a customer, in connection with your User Materials or otherwise, without your prior written consent. Consent, when given, can be withdrawn by email.
Suggestions. If you send us ideas or suggestions about the Site, the Software or the Services, we may use them to improve our products without owing you anything, but this never gives us a right to your User Materials beyond the license above, and never a right to name you.
We do not pre-screen User Materials. You are responsible for what you post. We are not responsible for storing User Materials and may remove them as §5 says.
7. Third-party links and services
The Site links to other sites and uses third-party services (for example, payment processing, video hosting and our help desk). We do not control those sites or services and are not responsible for their content, availability or practices. Their own terms and privacy policies apply when you use them.
8. Privacy
How we collect and use personal information is described in our Privacy Policy at in5.us/legal/privacy/. Business customers: the EULA (§11) sets out our security and data-protection commitments, including notice of a security incident affecting your data within 72 hours and a data-processing agreement on request.
9. Warranties and disclaimers
THE SITE, THE SERVICES AND THE MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR MATERIALS WILL MEET YOUR REQUIREMENTS. YOU USE THE SITE AND DOWNLOAD MATERIALS AT YOUR OWN RISK AND ARE RESPONSIBLE FOR ANY RESULTING DAMAGE TO YOUR SYSTEMS OR LOSS OF DATA. THE SOFTWARE'S WARRANTY, IF ANY, IS SET OUT IN THE EULA.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TIKA AND ITS MEMBERS, OFFICERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, THE SERVICES OR THE MATERIALS, EVEN IF ADVISED OF THE POSSIBILITY. TIKA'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE IS LIMITED TO ONE HUNDRED US DOLLARS (US$100). LIABILITY RELATING TO THE SOFTWARE OR A SUBSCRIPTION IS GOVERNED BY THE EULA. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE, THESE LIMITS APPLY TO THE EXTENT PERMITTED.
11. Copyright complaints (DMCA)
We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. §512, and will end the accounts of repeat infringers. If you believe your work has been copied on the Site in a way that infringes your copyright, send a written notice containing the information required by §512(c)(3) to our designated agent: Copyright Agent, TIKA Solutions LLC, 20860 N Tatum Blvd, Suite 300, Phoenix, AZ 85050, USA — support@in5.us (subject line "DMCA notice"). Use this address only for copyright notices; other questions go to support@in5.us.
12. Indemnity
You agree to defend, indemnify and hold harmless TIKA and its members, officers, employees and contractors from any third-party claim, and the reasonable costs and attorneys' fees of defending it, arising from your User Materials, your use of the Site or the Services, your breach of these Terms, or your violation of any law or of another person's rights.
13. Governing law and disputes
These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-law rules. Any dispute arising from them or from your use of the Site will be brought in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction. If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, the Privacy Policy and (for the Software and subscriptions) the EULA are the whole agreement between you and TIKA about the Site.
